CONTRACTS WITH OUTSIDE AGENCIES

(LEGAL)

 

CAREER AND TECHNOLOGY EDUCATION

The Board may contract with another public school district, public or private post-secondary institution, or trade or technical school that is regulated by the state, as designated in the state plan for career and technology education, to provide career and technology classes for District students. Education Code 29.184(a) [See EHBF]

In addition, the Board may develop and offer a program that provides a rigorous course of study consistent with the required curriculum and under which a student may receive specific education in a career and technology profession. Education Code 29.187 [See also CRB and EHBF]

STUDENTS WITH DISABILITIES

The District may contract with a public or private facility, institution, or agency inside or outside of Texas for the provision of services to students with disabilities. Each contract for residential placement must be approved by the Commissioner, who may approve a residential placement only after at least a programmatic evaluation of personnel qualifications, adequacy of physical plant and equipment, and curriculum content. The Commissioner may approve either the whole or a part of a facility or program. Education Code 29.008(a) [See EHBA]

EDUCATIONAL SERVICES

The Board may contract with a public or private entity for that entity to provide educational services for the District. Education Code 11.157

PRE—K LICENSING STANDARDS

 

If the District contracts with a private entity to operate a prekindergarten program, the program shall comply at a minimum with the applicable child-care licensing standards adopted by the Texas Department of Protective and Regulatory Services under Human Resources Code 42.042. Education Code 29.1532(b)

DRIVER TRAINING SCHOOLS

A District school may enter into an agreement with a licensed driver training school to allow the driver training school to conduct a driver training course at the public school for public school students. Education Code Title 5, Chapter 1001

MILITARY INSTRUCTION

The Board may contract with the proper governmental agency with respect to the teaching of courses in military training, and it may execute, as principal or surety, a bond to secure the contracts to procure arms, ammunition, animals, uniforms, equipment, supplies, means of transportation, or other needed property. Education Code 29.901


Note:

This provision applies only to those districts in which military instruction is conducted under state or federal law requiring the District to give bond or otherwise indemnify this state, the United States, or any authorized agency for the care, safekeeping, and return of property furnished.
